Debt Recovery Solicitors in Chandler's Ford

Every business will experience their periods of growth as well as times of financial hardship, whether that is due to factors within their control or external contributors.

All organisations should therefore have well defined and tailored credit control processes in place detailing how they will ensure there is sufficient cash flow in place to account for any future eventuality.  When this is not the case and businesses struggle to recover outstanding debts, this can lead to unpaid debts of their own, the threat of broken business relationships and uncertainty for their employees and their reputation.

How can Warner Goodman LLP reclaim my debts?

Our Debt Recovery team has been supporting organisations with their business to business debts for over 35 years, working with a variety of seniority levels within the business as well as many different sectors, such as retail, hospitality, manufacturing and distribution networks.

Many businesses may believe they can recover outstanding invoices on their own, however this takes time and effort that you may not be able to spare.  By coming to us, we can remove the burden from your shoulders and manage the entirety of the process, from the pre-action protocol to enforcement of the judgment, as follows:

  1. Pre-action protocol - this differs between business and individual debts.  For business debts, we will send your debtor a Letter Before Action (LBA) which will confirm to them the amount that is outstanding, the contract or terms and conditions in place that require payment is made, when the payment was due and what action will be taken should they continue to default on their payment.
  2. Court application - in the unlikely scenario that the LBA does not encourage payment from your debtor, we will then manage the Court process on your behalf, which can be burdensome when attempted in-house.
  3. County Court Judgment - the next step following the Court application would be to apply for a County Court Judgment, which most organisations will wish to avoid as this will impact their future credit rating.
  4. Enforcement of the judgment - finally, if we have not been successful up until this point, we will work in conjunction with our third parties to obtain the payment in other ways.

Through our unique pricing structure, state of the art software, years of experience and wider connections, you can ensure a swift, pragmatic approach to your debt recovery needs, seeking to maintain your relationship with your debtor if you wish and reviewing your current credit control practices to reduce the risk of future issues arising.
