Understanding the Legal Basis for Divorce

While every relationship is unique, the law in England and Wales has simplified the process of ending a marriage by establishing one clear legal requirement: the marriage must have irretrievably broken down. This means couples no longer need to prove fault, such as adultery or unreasonable behaviour, when applying for a divorce, and the process can be initiated by one person or jointly by both spouses.

By removing the need to assign blame, the system helps reduce conflict during an already challenging time. The focus instead is on resolving practical matters, such as dividing assets and arranging child custody, allowing both parties to move forward more constructively.

How to Apply for Divorce

The divorce process in England and Wales is relatively straightforward, but recent legal changes mean it’s important to fully understand each step before proceeding.

To start, a divorce application must be submitted to the court, along with the current court fee of £593. This application must include a statement confirming that the marriage has irretrievably broken down. The application can be made jointly by both spouses or by one person alone.

If only one spouse applies, the court will send a copy of the application to the other spouse (the respondent). They are then required to complete and return an ‘acknowledgement of service’ form within 14 days, confirming they have received the application.

Once the court has received this acknowledgement, there is a mandatory waiting period of at least 20 weeks. After this time, the applicant(s) can apply for the Conditional Order (previously known as the Decree Nisi), which is the first formal step toward ending the marriage.

Following the Conditional Order, there is a further waiting period of six weeks and one day. After this, the applicant(s) can apply for the Final Order (previously called the Decree Absolute), which legally ends the marriage.

While the divorce process handles the dissolution of the marriage, issues such as financial settlements and child arrangements are dealt with separately and may require additional legal advice.
