Commercial Contract Disputes

“A formal agreement is one made in writing and which is authenticated by the practice of ‘sealing’”

The Dispute Resolution team recognise that no matter how careful anyone can be in preparing a contract, at times those terms can be open to interpretation or abuse.  Whether the contract is with a supplier or a customer for goods or services, or affects the warranty, we can help resolve the problem quickly and practically helping to safeguard the reputation of the business.

We see court proceedings as a last resort and will, wherever possible, consider with the client alternative methods of dispute resolution, including negotiation, mediation and arbitration.  However, if the matter is urgent, we are able to issue proceedings for injunctive relief or other appropriate remedies, even in complex cases, at short notice.

We recognise that litigation can be expensive.  We can explore with the client the funding of litigation and in certain circumstances will explore conditional fee agreements backed up by after the event insurance.
