When a marriage has irretrievably broken down

Entitlement
You can only get a divorce if you have been married for a year.

Grounds for divorce
1. Adultery
2. Unreasonable behaviour
3. Continuous separation for 2 years where both parties agree to divorce.
4. Where parties have been separated for 5 years and one party does not consent.
5. Where one has deserted the other for 2 years.

Petition
Sets out details of marriage, with names, addresses and why it is believed the marriage has broken down.

Acknowledgment of Service
This will ask the Respondent if they object to the Divorce Petition or whether they want to defend it.

Decree Nisi
The penultimate order in the process. After this date the court can make orders regarding finances.

Decree Absolute
This ends the marriage.

Details of children, including schools attended and any special needs.
